1. Validity of the Conditions

The following conditions apply to consumers.

 

2. Prices

The prices are based on the currently valid price lists of BAHOMI GMBH. VAT is shown separately on the invoice.

 

3. Conclusion of the contract

The presentation of the products in the online shop does not represent a legally binding offer, but rather a non-binding online catalogue. After entering your personal data and clicking on the “Complete order” button in the final step of the ordering process, you place a binding order for the items in the shopping cart goods off.

BAHOMI GMBH confirms the order to the customer by e-mail, so that the contract is concluded.

 

4. Delivery

The goods travel at the expense and risk of the buyer. Shipping costs include postage checked packaging, insurance and transport. When shipping abroad, the shipping costs are to be requested separately. The dispatch takes place one working day after receipt of the purchase price (in the case of advance payment), in the case of collection by direct debit on the day of the inspection.

You have the right to revoke this contract within fourteen days without giving reasons.

The cancellation period is fourteen days from the day on which you or a third party named by you who is not the carrier took possession of the goods.

In the case of partial shipments or pieces: on which you or a third party named by you who is not the carrier took possession of the last goods.

In order to exercise your right of withdrawal, you must inform us

by means of a clear statement (e.g. a letter sent by post, fax or e-mail) of your decision to withdraw from this contract. You can use the attached sample revocation form for this, but this is not mandatory.

To meet the cancellation deadline, it is sufficient for you to send the communication regarding your exercise of the right of cancellation before the cancellation period has expired.

 

Consequences of revocation

If you revoke this contract, we have paid you all payments that we have received from you, including the delivery costs (with the exception of the additional costs resulting from the fact that you have chosen a different type of delivery than the cheapest standard delivery offered by us have), immediately and at the latest within fourteen days from the day on which we received the notification of your cancellation of this contract. For this repayment, we use the same means of payment that you used in the original transaction, unless something else was expressly agreed with you; under no circumstances will you be charged fees for this repayment. We may refuse repayment until we have received the returned goods or you have provided proof that you have returned the goods, whichever is earlier.

You have the goods to us immediately and in any event not later than fourteen days from the day on which you inform us of the cancellation of this contract

to be returned or handed over. The deadline is met if you send back the goods before the period of fourteen days has expired. You bear the direct costs of returning the goods.

You only have to pay for any loss in value of the goods if this loss in value is due to the handling of the goods that is not necessary to establish the nature, properties and functioning of the goods.

6. Payment

The buyer can choose to pay either in advance or via PayPal. Payment has only been made when Bahomi GmbH can dispose of the amount. Bank charges and a processing fee will be charged to the buyer for unpaid direct debits. If the buyer is in default, the statutory default interest (5% above the base interest rate) will be charged.

 

7. Retention of Title

The goods remain the property of Bahomi GmbH until all claims from the purchase contract have been paid in full.

 

8. Severability

Should one or more of these provisions be or become invalid, this shall not affect the validity of the remaining provisions. Rather, a provision that is effective and that comes as close as possible to the invalid provision is deemed to be agreed.
